Heard Ms. Usha Tiwari, learned counsel for the petitioner and learned Standing Counsel. 2. The present petition has been filed with the following relief: "(i) A writ, order or direction in the nature of Mandamus commanding the opposite parties no.2 to 4 to remove illegal encroachment over the land Gata No.142/0.009, 171/0.033, 172/0.009, 173/0.0012 situated at village Vibharpur, Rupinpur, Tehsil- Jaisinghpur, District-Sultanpur from the opposite party no.6 to 8 and to take a coercive action against the opposite party No.6 to 8 The Land in question is a Pond Land, public Way and vested in Gaon Sabha." 3. Learned Standing Counsel, based upon the instructions, states that a suit has already been filed and is pending. 4.
