Heard learned counsel for the petitioner and learned Standing Counsel. 2. The present petition has been filed with the following relief: "(i) Issue a writ, order or direction in the nature of Mandamus commanding/directing the opposite party no 2 & 3 to remove the encroachment over Khata No.1192, Gata No.1947, area 0.1030 in respect of encroachment over public utility land situated at Village Hathagawan, Pargana Bihar, Tehsil-Kunda, District-Pratapgarh from the possession of the opposite parties no 5 to 9." 3. Learned Standing Counsel, based upon the instructions, states that a suit has already been filed and is pending. 4. In view thereof, the present petition is disposed of with direction to conclude the said proceedings expeditiously within a period of 90 days.
