Heard Shri Satya Prakash, learned counsel for the applicant and Shri Ashutosh Singh, learned A.G.A. for the State-respondent. 2. The instant bail application has been filed seeking release of the applicant on bail in Case Crime No.433 of 2024, under Sections 3(5), 103(1), 238, 309(6), 317(2) B.N.S., Police Station Akrabad, District Aligarh, during pendency of the trial in the court below. 3. Learned counsel for the applicant submits that it is a case of circumstantial evidence and nobody was named in the FIR but during investigation through the statement of witness Avanish, applicant has been made accused in the present matter but even from his statement, which has been annexed alongwith the instant bail application, the complicity of the applicant could not be revealed. He further submits, even the statement of witness Avanish was recorded after 25 days. 4. He further submits that
