Heard learned counsel for the applicant, Shri Puneet Kumar Singh, learned AGA for the State-respondents and perused the record. This bail application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 has been moved on behalf of accused-applicant, Shivam Nishad , seeking enlargement on bail in Case Crime No. 04 of 2025 , under Sections 319(2), 318(4), 338, 336(3), 340(2), 3(5) of the Bharatiya Nyaya Sanhita, 2023 & Section 66(D) of I.T. Act, Police Station Ramgarhtal, District Gorakhpur. Learned counsel for the applicant argued that the accused- applicant is innocent. He has been falsely implicated in this very case crime number and is languishing in jail since 3.1.2025. Learned counsel for the applicant submits that the applicant is not named in the FIR. F.I.R. was lodged on 1.1.2025 by the first informant Raj Kumar against one named person Raja and three unknown persons. He
