Hon'ble Siddharth,J. Rejoinder-affidavit filed today is taken on record. Heard learned counsel for applicant, learned A.G.A. for the State and perused the record. This bail application has been preferred by the accused- applicant, Chandresh @ Babbu Yadav, who is involved in Case Crime No.514/2024, under Section 8/20/29/60 of N.D.P.S. Act, Police Station- Robertsganj, District- Sonbhadra, There is allegation against the applicant that he was found in possession of 150 kg of ganja alongwith four other persons. Learned counsel for the applicant has submitted that by way of Notification dated 23 December, 2022, the Union Government has notified the enactment Narcotic Drugs and Psychotropic Substances (Seizure, Storage, Sampling and Disposal) Rules, 2022. Chapter II of the aforesaid rules provide for Sampling of the contraband substance. Rule 10 categorically provides that: 10. Drawing the samples. - (
