Heard Shri Hasan Parvej, holding brief of Shri Ramajan Ahmad, learned counsel for applicant, learned A.G.A. for the State and perused the record. This bail application has been preferred by the accused-applicant, Rizwan Khan, who is involved in Case Crime No. 236 of 2024 under Section 8/18 N.D.P.S. Act, Police Station- Meerganj, District- Bareilly. There is allegation of recovery of four Kg. opium from the possession of the applicant. Learned counsel for the applicant has submitted that applicant has been falsely implicated in the present case due to ulterior motive, on the basis of false and planted recovery of four Kg. opium and there is no public witness of the alleged recovery. He further submits that the mandatory provisions contained in sections 41,50,52,53 & 57) of the NDPS Act were not complied with while making the alleged search and recovery.It is further contended
