Supplementary affidavit has been filed by learned counsel for the applicant and counter affidavit has been filed by learned AGA, which are taken on record. Heard learned counsel for the applicant as well as the learned AGA for the State and perused the material placed on record. The instant bail application has been filed on behalf of the applicant, Rupesh Kumar Jha, with a prayer to release him on bail in Case Crime No. 483 of 2024, under Sections 376(3) IPC and 3/4 POCSO Act, Police Station Indirapuram, District- Ghaziabad, during pendency of trial. There are allegations against the applicant of committing the offence of rape against a minor girl. Learned counsel for the applicant has submitted that although the victim is minor, but she left her house on her own sweet will and went to meet the applicant.
