Counsel for Applicant :- Praveen Kumar Singh,Rajesh Kumar Tiwari Counsel for Opposite Party :- Devesh Kumar,G.A.,Sharad Kumar Singh Hon'ble Siddharth,J. Heard Shri Praveen Kumar Singh, learned counsel for the applicant; Shri Devesh Kumar, learned counsel for the informant and learned A.G.A for the State. There are allegations against the applicant of torturing his wife on account of unfulfilled demand of dowry. There is also allegation that miscarriage of child of the informant was caused without her consent by the applicant. Learned counsel for the applicant submits that informant is second wife of the applicant while applicant was also married earlier to a women,who died. Applicant has been falsely implicated in this case.The alleged demand of dowry is not credible in second marriage of the applicant with victim. There is no evidence of causing offence under section 313 I.P.C. by the applicant.The applicant is in jail since 19.4.2024 and has no criminal history to his credit.
