Heard Shri Ashok Kumar Singh, learned counsel for the applicant, Shri Umesh Kumar Singh, learned State Law Officer for the State and perused the record of the case. The present bail application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of applicant, Roshan Yadav with a prayer to release him on bail in Case Crime No. 262 of 2024, under Section 8/20/29 of Narcotic Drugs and Psychotropic Substances Act, 1985, Police Station- Saidpur, District- Ghazipur. Learned counsel for the applicant has contended that 116 Kg. Ganga is alleged to have been recovered from the car i.e. Swift Dzire. The applicant was not driving the said car nor was sitting in that car. The applicant was nabbed at the time of driving of motorcycle i.e. Pulsar.
